I Heart Puppies CRUMBLES –Exposed Fraud and Lies of Inhumane Puppy Mill Sales

Refusing requests to practice ethical humane business, I Heart Puppies closes shop , making unconscionable move to expand investments of cruetly and torture in unregulated Internet puppy mill sales.

Opportunity Lost-
Some may expect a humane advocate protester of IHP Puppy Mill Sales would be jumping for joy.   Our Protest  was not a battle of imposing will, but a battle to aide in diminishing a national crisis of  horrific canine cruelty, and aide needed humane opportunities for the city .  I Heart Puppies’ Brooke and Suanne Bradford ‘s Deep commitment to inhumane industry, denied our canine compassionate community a venue to create value, revenue , and  opportunity for humane pet sales, contributing to our citizen and canine welfare needs, while making exceptional and respectable honest profits.
What was the cost to the city for promoting and investing in unethical inhumane fraudulent sales of animal cruelty?
An endless string of unfortunate occurrences involving I Heart Puppies fraudulent misrepresentation was promoted and enabled by institutions citizens rely upon for integral preservation of ethical business and municipal duties.
CDM Chamber marketed Fraud model.  Animal control negligence to enforce state law- engaging in private business animal trade for profit of our own homeless ,depriving them of legal advocacy.  Private business Illegal solicitation of charitable funds abusing tax payer services...and so on.
May the city of Newport Beach gain new insight to the hazards of promoting business at all costs, when business runs solely off a Fraud Model void of supply and demand.   The added sting, an industry of federal canine torture which congress and the entire nation are working furiously to regulate and overhaul,.  Newport  can no longer afford investing in it's growth, directly victimizes its own  citizens.
Had the city taken action and passed an ordinance banning Puppy Mill Sales in Newport, instead of offering resources, we would be celebrating 8 months of growth in revenues, creation of new jobs, displaying leadership in innovative, humane  high end business models, while providing housing opportunities for our homeless, diminishing federal cruelty….., instead of investing in it's growth.
On behalf of humane protesters I would like to thank the community of Corona Del Mar for your continuous support.   The support of the community kept us strong, fighting animal abuse injustice, for the greater good of our beautiful city.
A special Thank You to Honorable Mayor Nancy Gardner , in addressing the rights of her humane ethical citizens,  maintaining an ethical level playing field, and her  investment of valuable time spent gaining further insight on the facts of our  National Disgrace, the Puppy Mill Trade, still very much alive and prospering in Newport Beach.

CAPS MAKING HEADLINES AGAIN : Dog-Lovers Howl Over Alleged Puppy Mills

CAPS MAKING HEADLINES AGAIN : Dog-Lovers Howl Over Alleged Puppy Mills

Dog-Lovers Howl Over Alleged Puppy Mills

CHICAGO (CN) - Six puppy owners claim in a class action that the Happiness Is Pets chain store misrepresents that its puppies come from small-scale breeders, though they actually come from "some of the most despicable and horrendous puppy mills in the Midwest."
Lead plaintiff Jane Clifford seeks punitive damages from 18 Happiness Is Pets branches in the Chicagoland area, and their owner Ronald Berning.
"Plaintiffs purchased sick puppies sold by Happiness which falsely represented that its puppies were healthy and came from private and reputable breeders. In fact, the puppies at Happiness are often sick and come from some of the most despicable and horrendous puppy mills in the Midwest," the complaint states.
It adds: "On information and belief, many puppies, no more than 8 weeks old, arrive at Happiness in crowded vans, packed in crates covered with feces and urine, shaking and visibly stressed, many sick. Happiness employees are directed to bathe and groom the puppies and administer antibiotics and deworming treatments daily, in an effort to mask the unhealthy condition of the puppies to unsuspecting consumers and of which dangerously jeopardizes the puppy's immune system."
The plaintiffs' attorney Edward Clinton Jr. said in an interview with Courthouse News: "We received so many calls from so many people who had problems with Happiness pets that we thought it incumbent on us to file a lawsuit."
The plaintiffs claim that "the breeders used by Happiness fit perfectly within the definition of 'puppy mill' as defined by Happiness. Many of Happiness' breeders are cited by the United States Department of Agriculture (USDA) for violations including but not limited to failure to provide veterinary care, lack of exercise, and improper housing enclosures. For example, the USDA reported that 'Breeder A,' a main breeder used by Happiness, failed to provide veterinary care to a blind dog with crusty eye discharge and to another dog with no teeth."
The class claims that "the USDA reported an inventory count of another breeder used by Happiness, 'Breeder B,' of 890 dogs and 315 puppies. ...
"'Breeder B' is not a private, small-scale breeder as Happiness falsely represents, and it is a mass producing dog facility.
"An investigation by the Companion Animal Protection Society (CAPS), a nonprofit organization dedicated to protecting companion animals, further revealed a burn pile of puppies at 'Breeder B,'" according to the complaint.
The plaintiffs say: "These deceptions are perpetrated so as to prevent plaintiffs from realizing the obvious - that purchasing a puppy from Happiness is a terrible idea and is financially and emotionally burdensome."
Plaintiff Bryan Phillips says he bought his puppy, Dakota, from Happiness in December 2011 for about $809.
"Shortly after Phillips' purchase, Dakota tested positive for distemper," the complaint states. "Dakota showed signs of illness immediately. He took Dakota to Happiness' recommended vet who dismissed her symptoms as a common cold and gave her a drug. Dakota's symptoms quickly worsened and Phillips took Dakota to his family vet, who noticed the signs of distemper instantly. A further X-ray showed Dakota had pneumonia as well. Dakota suffered from tremors, seizures, vomiting, severe diarrhea, coughing, eye and nose discharge, sneezing, respiratory problems, conjunctivitis and corneal ulcers."
Plaintiffs Lissett Dzieglo and Mark Jillich say they bought their puppy, Gunner, from Happiness in January this year, for $976.
"Gunner showed signs of illness immediately, including a severe cough, difficulty breathing and congestion," the complaint states. "Gunner was taken to the vet approximately five times in a matter of weeks. The coughing quickly worsened and elevated to bronchitis, eye and nose discharge, increased breath, clumsiness, lack of energy, and yelping in pain."
The other plaintiffs say their puppies suffered similar health problems.
"Our first goal is to get a class certified," Clinton said.
The plaintiffs seek punitive damages for fraud, negligent misrepresentation, and breach of implied warranty, and want Happiness enjoined from continuing its allegedly deceptive practices. They also seek refunds of the price of the puppies, including all items associated with the purchases, and veterinary expenses.

-Lawsuit accuses Happiness is Pets with

 consumer fraud

Dakota was purchased by Bryan Phillips and his girlfriend from Happiness is Pets and has been diagnosed with distemper.

Six families that purchased puppies from various Happiness is Pets stores in the Chicago-area that later became ill with distemper have filed a lawsuit against the chain. In the suit filed in DuPage County Court earlier this week, the plaintiffs claim that Happiness is Pets (HIP) commits consumer fraud by misrepresenting the origin of the puppies it sells.
The suit seeks damages from all of the stores in the chain along with owner Ronald Berning. It states that Happiness is Pets misrepresents that its puppies come from small-scale breeders when they actually come from “some of the most despicable and horrendous puppy mills in the Midwest.” The chain made headlines last month when several puppies sold by HIP were diagnosed with distemper, a very contagious and deadly disease.
Update in the distemper cases
According to the Humane Society of the United States today, there have been eleven confirmed distemper cases affecting five HIP stores with many more suspected cases. At least five of the dogs with confirmed cases have died and several other puppies died before they were tested. The HSUS says the dogs were sold at the stores between November 2011 and January 2012. The organization has received reports from some buyers that indicate the store’s vet has been refusing to test some of the sick puppies for distemper claiming that they fear “false positive” results even when the dogs have clinical symptoms.

The suit
“The cases have been linked to several different breeders so the exact source of these cases has not yet been determined, but that is really up to the Department of Agriculture to investigate,” says Kathleen Summers, Director of Outreach and Research, Puppy Mill Campaigns for HSUS. “We believe the majority of puppies may have been exposed during transport to the HIP store chain since we are not aware of any other pet stores that have been affected yet.”
The suit focuses on two uniform misrepresentations it claims is made by Happiness is Pets –
  • First it claims that HIP tells its customers that the puppies are healthy, “failing to disclose that many have been continuously treated for health problems since arriving at their stores. The store also fails to disclose the full medical history of the dogs that it sells including which animals are on antibiotics.”
  • Secondly, the store claims that their dogs come from some of the best small-scale breeders in the Midwest. The suit alleges that HIP’s puppies come instead from large-scale “puppy mills that do not ensure its dogs receive the proper necessities, including veterinary, shelter and exercise necessitates.”
The plaintiffs are seeking a full refund of the purchase price of the puppies including tax and fees along with veterinary and other expenses resulting from the purchase of sick puppies. One of the plaintiffs in the case is Bryan Phillips, who purchased his Dachshund Dakota from the store shortly before Christmas. Although the dog has been slowly recovering, Dakota did have a health set back over the weekend with diarrhea and vomiting.
“On the bright side of things, the vet believes the distemper virus is no longer in her system and if she was going to succumb to it, it would have happened by now,” says Phillips. “Now that leaves us with all the long term side effects of the disease. I can place a big bold check mark next to gastrointestinal issues. Next up is if her adult teeth will have enamel on them. Time will only tell. This is troubling because accord to her pet record she is around four months of age. At this time, her adult teeth should start to be coming through which they are not.”
In an interview earlier this year (see story), Phillps said that he had purchased Dakota along with his girlfriend because they wanted a healthy puppy from a good breeder. I'll have a more indepth look at Dakota's story later this weekend.

Lawsuit accuses Chicago-area chain of selling dogs from puppy mills

Lawsuit accuses Chicago-area chain of selling dogs from puppy mills

One of 43 puppies found Tuesday in a van in the Little Village neighborhood is shown at Chicago's Animal Care and Control office. The department has taken custody of the puppies, pending the results of a legal case against two men allegedly found in possession of them. (HANDOUT / February 8, 2012)

A half-dozen puppy owners have filed a lawsuit alleging that the Chicago-area Happiness is Pets retail chain sells ailing, disease-prone puppies from squalid, overcrowded puppy mills.

Visibly sick, distressed puppies have been transported to Happiness Is Pets stores in crowded vans, packed into crates, covered in feces and urine, according to the lawsuit that names nearly 20 branches of Happiness Is Pets.

Stores duped customers, the lawsuit claims, by assuring them the animals came only from small, reputable breeders.

“In fact, the puppies at Happiness are often sick and come from some of the most despicable and horrendous puppy mills in the Midwest,” the lawsuit says. “Plaintiffs were deceived into buying sick puppy-mill puppies.”

An observer at one puppy mill that allegedly supplieddogs to the stores saw what's described in the suit as “a burn pile of puppies.”

Several messages left for Happiness is Pets owner Ronald Berning at different locations around Chicago on Friday were not returned. A message left at a residential telephone number for a Ronald Berning was also not returned.

The company's website says its stores only sell puppies — more than 50 breeds, from beagles and Yorkie-poos to pugs and cockapoos. The website says the chain has been “providing the Chicago area with healthy, happy puppies for over 20 years.”

“We take pride in dealing exclusively with the best private breeders throughout the Midwest,” the website says. “A full 50 percent of our business comes from satisfied customers and referrals.”

But the lawsuit says the plaintiffs have suffered both emotionally and financially as they were forced to take their ill puppies for frequent veterinarian visits. They are seeking compensation for their losses and punitive damages.

Happiness Is Pets sought to conceal the poor condition of puppies, the lawsuit asserts, by having staff carefully groom and deworm them, and also by administering antibiotics that mask underlying ailments.

Plaintiff, Jane Clifford describes buying her puppy, Missy, two years ago from Happiness Is Pets for $798 — only to discover once she got the dog home that it suffered from a urine infection, kennel cough and other illnesses.

“Had Clifford been aware that Missy was sick and came from a puppy mill, she would never have purchased Missy,” says the lawsuit, which did not identify the dog's breed.

Newportbeachpuppymill.com ~ ABC's Bachelor Lorenzo Borghese speaks out about pet stores and puppy mills

ABC's Bachelor Lorenzo Borghese speaks out about pet stores and puppy mills

New York - You might not be a fan of ABC's show, "The Bachelor," but if you're an animal advocate, you'll love the message that former Bachelor Lorenzo Borghese is spreading.
He's trying to raise consumer awareness about where puppies in pet stores really come from, as well as the cruelty of puppy mills. It's amazing how many people still don't know the connection between puppy mills, backyard breeders, and online sites that sell puppies to pet stores. We can't seem to say it enough.
Borghese went to pet stores all over New York to investigate where they got their puppies. He speaks about the cruelty of puppy mills and the deception and greed of pet stores, who have no regard for the health and living conditions of puppy mill breeder dogs, which is where all pet store puppies come from. It's all about the almighty dollar to them.
I know personally that pet stores will not give you a straight answer, as Borghese also explains. You can tell it's a scripted response to your question. They paint a lovely picture of how the puppies' parents are living the good life, while in actuality they are living a lonely, neglected life in a cage, without clean food and water, covered in feces in wire cages, never allowed out, and inbred over and over.

Many online pet stores have images on their sites of bright green grass, with happy dogs running freely and enjoying the sunshine. This could not be farther from the truth, and it's simply a way to deceive the consumer. These dogs have never even felt grass under their feet.  If they showed you what was really going on, you would be appalled.
And when these dogs serve no more purpose to the puppy miller, they are sometimes killed.
Often the puppies from mills develop serious health problems that end up costing their owners thousands of dollars. This is a result of the terrible conditions their parents lived in, and the fact that they are inbred.
Does that sound like a good life to you? I have been told by pet store owners, "Oh no, we don't buy from puppy mills." They won't share the truth, so the lies never end.
When Borghese asked, "Is there a kennel name, something I can look up?", their response was, "That I can't give you. Not until you buy the dog." That should be an unacceptable response for any consumer. That should make anyone receiving that answer turn and walk out immediately.
In fact, you should never step foot into a pet store that sells animals, even to purchase supplies for your pet. Always shop at a store that only sells supplies or works with shelters to adopt homeless animals.
Make no mistake. If you buy a pet from a pet store, online brokers, or backyard breeders, you are buying a puppy mill dog and you are contributing to a money-making industry that condones cruelty and the inhumane treatment of animals.
Instead, please go to Petfinder.com or your local animal shelter to find your next pet. There are millions of dogs and cats killed in shelters every year who would have lived longer and healthier lives if given the chance.
Please pass this information to your family and friends so they will be able to make the right decision when looking for their next four-legged family member. This message cannot be shared enough. In fact, we can't stop sharing it until every consumer knows the truth about that "doggy in the window." Hopefully that will be when we will finally be able to say "goodbye" to these large scale commercial breeding operations, called puppy mills.

I Heart Puppies and Russo's ~ From Puppy Mill to Pet Store, a Veterinarian Follows a Young Dog's Journey from their Midwest Breeders to Pristine Newport Beach

From Puppy Mill to Pet Store, a Veterinarian Follows a Young Dog's Journey

Cocker Spaniel in cage
Dreamstime
Joe and Cindy first laid eyes on Chloe when they passed through a pet store on their way to a movie. They never saw the weekend blockbuster but instead fell in love with a little blond Cocker Spanel puppy with big brown eyes and bought her on the spot.
Chloe was adorable and quickly became part of the family, but Joe and Cindy noticed right from the start that Chloe drank lots of water and had many accidents in the house. A few months later, when she began vomiting and refusing her food, they brought her in to me and I diagnosed kidney failure caused by a birth defect. By the time she was 11 months of age, the once-playful puppy became profoundly weak and lethargic and, unfortunately, I had no reasonable way of creating long-term improvement for Chloe. Joe and Cindy held their little girl as I ended her life.

The Tragedy of the Puppy Mill

This couple didn’t have to have their hearts broken this way. Though any pet can have unexpected medical issues, Chloe’s life likely began at a puppy mill, a veritable factory (disguised as a kennel) in which huge numbers of puppies are produced for profit. Puppy millers have no significant interest in the health histories of their breeding stock, so it’s no surprise that birth defects run rampant. Their sole objective is the mass production of purebred pups and the “designer hybrids” that are all the rage these days. Pups not used to fill pet store inventory are offered to the highest bidder at auction or sold online via websites that dupe naïve buyers into believing they are doing business with reputable breeders. Manufacturing puppies is big business.
Chloe’s story is not unusual, as completely healthy puppy mill dogs are the exception rather than the rule. Not all medical issues are life-threatening, but many require life-long management. Perhaps most common are behavioral issues significant enough that affected dogs are commonly relinquished to shelters or rescue organizations. Sometimes, the behavioral issues result in euthanasia.

The First Eight Weeks

Just like other forms of manufacturing, there is a system to the way dogs are typically bred and treated in puppy mills. It is likely that Chloe entered the world in a wire mesh cage or crate, no more than a few inches longer and taller than an adult Cocker Spaniel. Although mama was a purebred, her matted overgrown coat made her lineage undetectable. The “maternity ward” was overheated and poorly ventilated, with multiple cages stacked one on top of the other. Some of Chloe’s siblings didn’t “make it,” although it’s a wonder that any survived given their mother’s confinement within such a small, filthy environment, her compromised health (inadequate nutrition, parasites, dental and ear infections), and lack of downtime from pregnancy and caring for babies.
Chloe’s first few weeks of life were probably spent exclusively inside a cage and without any significant human contact. (The critical time during which pups learn about and develop their patterns for social interactions with other dogs and humans is between 3 and 12 weeks of age, so Chloe was already operating at a disadvantage.) She was well cared for by her mother (puppy mill breeders that are not good mothers are quickly culled from the pack). There was plenty of milk to be had; mama dogs are adept at sacrificing their own reserves before diminishing milk production.
At 5 weeks old, Chloe and her siblings were whisked from their mother and loaded into a van packed with crates crowded with other youngsters. (This is far too early to be separated. For purposes of socialization, pups should remain with their littermates for a minimum of eight weeks). Their destination was a puppy warehouse where brokers doled out their inventory to fill pet store orders. Chloe was one of many pups shipped from the Midwest to California. It was quite a journey for such babies, and not all the pups were alive or in the best shape upon arrival. But this was no surprise to those who unloaded the delivery. As with any perishable goods, there’s bound to be some damage during transit.

From Puppy Store to New Home

By 8 weeks old, Chloe was living in a pet store. Until this point, she’d never set foot out of her cage, but then, suddenly, she was being picked up and examined by many different human hands (some gentle, others not so gentle). When Chloe was 11 weeks old, Cindy and Joe happened by. They’d never before cared for a dog, but their emotions managed to override their sensibilities. They were reassured and encouraged by the pet store manager who “sealed the deal” by guaranteeing Chloe’s health. She could be returned and exchanged for another pup should she prove to be unhealthy.
Shortly after her adoption, Chloe was diagnosed with fleas, an ear infection and intestinal parasites. She had never voided anywhere but in her own cage, so, as with many puppy mill dogs, house training never made sense to her. In puppy class, Chloe appeared to be a social misfit. She was fearful of the instructor, and while the other pups played and wrestled, nervous Chloe steered clear of the activity. And then her health issues started, and, well, you already know the rest of Chloe’s sad story.

Creating Change

What can we do to stop this insanity? The best way to protect both pets and their future families is to actively campaign for the extinction of puppy mills. Write to legislators, sign petitions, join or initiate a peaceful protest at a dog auction. Make your voice heard against puppy mills.
More importantly, you can educate anyone and everyone you know (including your children) that the best way to adopt a pup is via a shelter or rescue organization, or purchase from a responsible breeder. Emphasize the importance of never, ever purchasing a puppy from a pet store or online, sight (and site) unseen. One less purchase from a puppy mill is one step closer to their eradication.

This store uses breeders that are violators of the USDA.. One of their breeders is under going criminal investigation for breaking Federal Law "The Animal Welfare Act", Nebraska State Law (it's a midwest Puppy Mill), and the USDA. They have admitted publicly that they use this breeder.

They have never been in the Pet store business before opening in Corona Del Mar. The owners have no regard for the health hazards of their patrons by supplying puppy mill dogs and lying about it. They commit consumer fraud and tell you they do not use puppy mills from out of state... Ask the Newport Beach City Council.. they were supplied with legal USDA documents and video footage or "I Heart Puppies" Puppy Mill Suppliers.

This store is unethical, supports, and supplies their puppy mill dogs from documented criminals who violate the law, and put the health and welfare of patrons and their children at stake.
