Dr. McMillan worked on the study with researchers from the University of Pennsylvania School of Veterinary Medicine, James Serpell and Deborah Duffy.  The study was based on a definition of puppy mill that defined them as "commercial breeding operations..., ... large scale facilities where dogs are confined in small enclosures for their entire lives with little to no exercise or positive human contact-for the sole purpose of mass-producing puppies to sell in retail pet stores and via the Internet."

I Heart Puppies "Pet Agenda " Puppy Mill Propaganda

I Heart Puppies "Pet Agenda " Puppy mill Propaganda
Same ploy used by Missouri Pet Breeders Association against Prob B-- I Heart Puppies Distributed MPBA High Gloss Pamphlets at their store-- MPBA ARE THE PUPPY MILL INDUSTRY LOBBYISTS

VIDEO:
Daily Show Satire "Big Red Dogs" Communist Pet Agenda

While we are clearing the air about the FACTS of Newports Investment in the Puppy Mill Industry, let’s get this  Humane Advocate Communist Pet Agenda off the table.   If you buy into the “Pet Agenda” phenomenon, your pea sized brain has been washed by the Puppy Millers and their retail pimp pet store owners.  Humane Advocates advocate for and value Canine Life.  Enough so that we take constant abuse from the ignorance stated through out these comments.  We care enough for Man’s Best Friend, that we don’t feel it is right or ethical that as a nation we are strapping them down in terror giving them the needle and choking them in terror stuffed in a gas chamber at the rate of 5 million a year, 500,000 a year in California, and almost 4,000 dogs only last year at O.C. Animal Care our county shelter.

We pretend to be a nation of canine lovers. Facts and Reality is we have become a nation of canine murderers in the Department of Agriculture and our Homeless shelters.  We have all found the experience of adoption to be overwhelming positive and so we hope through education and awareness that shelter stigma is shed and others might choose that option to save a life that would otherwise end up at the local dump.  What you all fail to acknowledge, we are the same people telling you how to find a  reputable breeder and how to safely purchase a HEALTHY puppy.  I provide reputable breeder checks for Newport Citizens because part of the reason we stand on the street is defending the consumer defrauding that is victimizing Newport Citizens in large numbers  with sick, diseased, and dead animals.  I read the council in meeting on record the letter of an 8 year old boy written to Russo’s that was forced to watch his new fatally diseased kitten die before his eyes… It was heart wrenching… BUT, COUNCIL DIDN’T CARE.

If I have the power to actually tell you, or force you into what type of pet you should acquire, I have a few more orders for the city like quit treating the disable like c—p, and fund more resources for domestic violence women.  Pet Agenda is propaganda the Bradford’s used to sell federal cruelty…and the result is people that are incapable of seeing the bigger picture fall for it, and start  promoting the  sale of canine federal cruelty as a consumer choice.   Federal Cruelty is not a consumer choice it’s a TRAGEDY.  If  you defend federal law breaking canine murders and line their pockets for your “choice”, congratulations… you are so dumb you have been brainwashed by people so unintelligent, the only way they can make a living through the abuse of defenseless animals….You are also a Product of the puppy mill industry…. Don’t believe me… watch this and then think twice before you lash out at those who respect life and defend those who torture and murder.  Wake up Newport Beach, you’re promoting the victimization of your neighbors and the death of Puppy Mill dogs bred for the Puppy Mill Puppies in Newport Beach.

CAPS MAKING HEADLINES AGAIN : Dog-Lovers Howl Over Alleged Puppy Mills

CAPS MAKING HEADLINES AGAIN : Dog-Lovers Howl Over Alleged Puppy Mills

Dog-Lovers Howl Over Alleged Puppy Mills

CHICAGO (CN) - Six puppy owners claim in a class action that the Happiness Is Pets chain store misrepresents that its puppies come from small-scale breeders, though they actually come from "some of the most despicable and horrendous puppy mills in the Midwest."
Lead plaintiff Jane Clifford seeks punitive damages from 18 Happiness Is Pets branches in the Chicagoland area, and their owner Ronald Berning.
"Plaintiffs purchased sick puppies sold by Happiness which falsely represented that its puppies were healthy and came from private and reputable breeders. In fact, the puppies at Happiness are often sick and come from some of the most despicable and horrendous puppy mills in the Midwest," the complaint states.
It adds: "On information and belief, many puppies, no more than 8 weeks old, arrive at Happiness in crowded vans, packed in crates covered with feces and urine, shaking and visibly stressed, many sick. Happiness employees are directed to bathe and groom the puppies and administer antibiotics and deworming treatments daily, in an effort to mask the unhealthy condition of the puppies to unsuspecting consumers and of which dangerously jeopardizes the puppy's immune system."
The plaintiffs' attorney Edward Clinton Jr. said in an interview with Courthouse News: "We received so many calls from so many people who had problems with Happiness pets that we thought it incumbent on us to file a lawsuit."
The plaintiffs claim that "the breeders used by Happiness fit perfectly within the definition of 'puppy mill' as defined by Happiness. Many of Happiness' breeders are cited by the United States Department of Agriculture (USDA) for violations including but not limited to failure to provide veterinary care, lack of exercise, and improper housing enclosures. For example, the USDA reported that 'Breeder A,' a main breeder used by Happiness, failed to provide veterinary care to a blind dog with crusty eye discharge and to another dog with no teeth."
The class claims that "the USDA reported an inventory count of another breeder used by Happiness, 'Breeder B,' of 890 dogs and 315 puppies. ...
"'Breeder B' is not a private, small-scale breeder as Happiness falsely represents, and it is a mass producing dog facility.
"An investigation by the Companion Animal Protection Society (CAPS), a nonprofit organization dedicated to protecting companion animals, further revealed a burn pile of puppies at 'Breeder B,'" according to the complaint.
The plaintiffs say: "These deceptions are perpetrated so as to prevent plaintiffs from realizing the obvious - that purchasing a puppy from Happiness is a terrible idea and is financially and emotionally burdensome."
Plaintiff Bryan Phillips says he bought his puppy, Dakota, from Happiness in December 2011 for about $809.
"Shortly after Phillips' purchase, Dakota tested positive for distemper," the complaint states. "Dakota showed signs of illness immediately. He took Dakota to Happiness' recommended vet who dismissed her symptoms as a common cold and gave her a drug. Dakota's symptoms quickly worsened and Phillips took Dakota to his family vet, who noticed the signs of distemper instantly. A further X-ray showed Dakota had pneumonia as well. Dakota suffered from tremors, seizures, vomiting, severe diarrhea, coughing, eye and nose discharge, sneezing, respiratory problems, conjunctivitis and corneal ulcers."
Plaintiffs Lissett Dzieglo and Mark Jillich say they bought their puppy, Gunner, from Happiness in January this year, for $976.
"Gunner showed signs of illness immediately, including a severe cough, difficulty breathing and congestion," the complaint states. "Gunner was taken to the vet approximately five times in a matter of weeks. The coughing quickly worsened and elevated to bronchitis, eye and nose discharge, increased breath, clumsiness, lack of energy, and yelping in pain."
The other plaintiffs say their puppies suffered similar health problems.
"Our first goal is to get a class certified," Clinton said.
The plaintiffs seek punitive damages for fraud, negligent misrepresentation, and breach of implied warranty, and want Happiness enjoined from continuing its allegedly deceptive practices. They also seek refunds of the price of the puppies, including all items associated with the purchases, and veterinary expenses.

-Lawsuit accuses Happiness is Pets with

 consumer fraud

Dakota was purchased by Bryan Phillips and his girlfriend from Happiness is Pets and has been diagnosed with distemper.

Six families that purchased puppies from various Happiness is Pets stores in the Chicago-area that later became ill with distemper have filed a lawsuit against the chain. In the suit filed in DuPage County Court earlier this week, the plaintiffs claim that Happiness is Pets (HIP) commits consumer fraud by misrepresenting the origin of the puppies it sells.
The suit seeks damages from all of the stores in the chain along with owner Ronald Berning. It states that Happiness is Pets misrepresents that its puppies come from small-scale breeders when they actually come from “some of the most despicable and horrendous puppy mills in the Midwest.” The chain made headlines last month when several puppies sold by HIP were diagnosed with distemper, a very contagious and deadly disease.
Update in the distemper cases
According to the Humane Society of the United States today, there have been eleven confirmed distemper cases affecting five HIP stores with many more suspected cases. At least five of the dogs with confirmed cases have died and several other puppies died before they were tested. The HSUS says the dogs were sold at the stores between November 2011 and January 2012. The organization has received reports from some buyers that indicate the store’s vet has been refusing to test some of the sick puppies for distemper claiming that they fear “false positive” results even when the dogs have clinical symptoms.

The suit
“The cases have been linked to several different breeders so the exact source of these cases has not yet been determined, but that is really up to the Department of Agriculture to investigate,” says Kathleen Summers, Director of Outreach and Research, Puppy Mill Campaigns for HSUS. “We believe the majority of puppies may have been exposed during transport to the HIP store chain since we are not aware of any other pet stores that have been affected yet.”
The suit focuses on two uniform misrepresentations it claims is made by Happiness is Pets –
  • First it claims that HIP tells its customers that the puppies are healthy, “failing to disclose that many have been continuously treated for health problems since arriving at their stores. The store also fails to disclose the full medical history of the dogs that it sells including which animals are on antibiotics.”
  • Secondly, the store claims that their dogs come from some of the best small-scale breeders in the Midwest. The suit alleges that HIP’s puppies come instead from large-scale “puppy mills that do not ensure its dogs receive the proper necessities, including veterinary, shelter and exercise necessitates.”
The plaintiffs are seeking a full refund of the purchase price of the puppies including tax and fees along with veterinary and other expenses resulting from the purchase of sick puppies. One of the plaintiffs in the case is Bryan Phillips, who purchased his Dachshund Dakota from the store shortly before Christmas. Although the dog has been slowly recovering, Dakota did have a health set back over the weekend with diarrhea and vomiting.
“On the bright side of things, the vet believes the distemper virus is no longer in her system and if she was going to succumb to it, it would have happened by now,” says Phillips. “Now that leaves us with all the long term side effects of the disease. I can place a big bold check mark next to gastrointestinal issues. Next up is if her adult teeth will have enamel on them. Time will only tell. This is troubling because accord to her pet record she is around four months of age. At this time, her adult teeth should start to be coming through which they are not.”
In an interview earlier this year (see story), Phillps said that he had purchased Dakota along with his girlfriend because they wanted a healthy puppy from a good breeder. I'll have a more indepth look at Dakota's story later this weekend.

Lawsuit accuses Chicago-area chain of selling dogs from puppy mills

Lawsuit accuses Chicago-area chain of selling dogs from puppy mills

One of 43 puppies found Tuesday in a van in the Little Village neighborhood is shown at Chicago's Animal Care and Control office. The department has taken custody of the puppies, pending the results of a legal case against two men allegedly found in possession of them. (HANDOUT / February 8, 2012)

A half-dozen puppy owners have filed a lawsuit alleging that the Chicago-area Happiness is Pets retail chain sells ailing, disease-prone puppies from squalid, overcrowded puppy mills.

Visibly sick, distressed puppies have been transported to Happiness Is Pets stores in crowded vans, packed into crates, covered in feces and urine, according to the lawsuit that names nearly 20 branches of Happiness Is Pets.

Stores duped customers, the lawsuit claims, by assuring them the animals came only from small, reputable breeders.

“In fact, the puppies at Happiness are often sick and come from some of the most despicable and horrendous puppy mills in the Midwest,” the lawsuit says. “Plaintiffs were deceived into buying sick puppy-mill puppies.”

An observer at one puppy mill that allegedly supplieddogs to the stores saw what's described in the suit as “a burn pile of puppies.”

Several messages left for Happiness is Pets owner Ronald Berning at different locations around Chicago on Friday were not returned. A message left at a residential telephone number for a Ronald Berning was also not returned.

The company's website says its stores only sell puppies — more than 50 breeds, from beagles and Yorkie-poos to pugs and cockapoos. The website says the chain has been “providing the Chicago area with healthy, happy puppies for over 20 years.”

“We take pride in dealing exclusively with the best private breeders throughout the Midwest,” the website says. “A full 50 percent of our business comes from satisfied customers and referrals.”

But the lawsuit says the plaintiffs have suffered both emotionally and financially as they were forced to take their ill puppies for frequent veterinarian visits. They are seeking compensation for their losses and punitive damages.

Happiness Is Pets sought to conceal the poor condition of puppies, the lawsuit asserts, by having staff carefully groom and deworm them, and also by administering antibiotics that mask underlying ailments.

Plaintiff, Jane Clifford describes buying her puppy, Missy, two years ago from Happiness Is Pets for $798 — only to discover once she got the dog home that it suffered from a urine infection, kennel cough and other illnesses.

“Had Clifford been aware that Missy was sick and came from a puppy mill, she would never have purchased Missy,” says the lawsuit, which did not identify the dog's breed.

How George Clooney's Rescue Dog Went from Kill Shelter to Hollywood

How George Clooney's Rescue Dog Went from Kill Shelter to Hollywood | George Clooney
George Clooney and dog Einstein
Laura Cavanaugh/Landov; Camp Cocker

How did an overweight shelter dog with an underactive thyroid end up living with George Clooney?

It's actually quite a tale.

When Cathy Stanley, founder of L.A.-area breed rescue Camp Cocker, made a stop at a high-kill shelter in June 2009, she only had room to take two cocker spaniels – but there were three others. Among them, a special pup named Einstein.

"He was in a filthy, crowded dog run with other dogs," reads the text in avideo about Einstein. "Poor Einstein was so afraid, he would leap backwards, trying to get away, and his rolls of fat were shaking."

Stanley ended up taking all five cocker spaniels that day, and Einstein, who was not only overweight but also had an underactive thyroid and dry eye, began his amazing trajectory toward Casa Clooney. Due to his condition, he was quickly taken out of a boarding facility and into a foster home with a Camp Cocker volunteer, who gave him lots of exercise and low-calorie food.

Clooney, who says he saw Einstein on the Internet, might have seen him onthis adoption page, which describes Einstein as "quite affectionate" and "a real teddy bear of a dog!"

According to the actor, he called to express interest in adopting the pup but was told that Einstein would have to like him first. So when Einstein paid his prospective adopter a visit in January 2010, Clooney did what anyone would do – he rubbed meatballs on his shoes – and Einstein was his!

"Forever, now, he just thinks of me as the guy with the meatball feet," Clooney told Esquire. "He loves me. I can do no wrong. He follows me everywhere."

That wasn't Clooney's only gesture: According to the video about Einstein, Clooney made a "generous adoption donation," which the rescue used "to pay down a big portion of our January vet debt that we'd been struggling with."

Newportbeachpuppymill.com ~ ABC's Bachelor Lorenzo Borghese speaks out about pet stores and puppy mills

ABC's Bachelor Lorenzo Borghese speaks out about pet stores and puppy mills

New York - You might not be a fan of ABC's show, "The Bachelor," but if you're an animal advocate, you'll love the message that former Bachelor Lorenzo Borghese is spreading.
He's trying to raise consumer awareness about where puppies in pet stores really come from, as well as the cruelty of puppy mills. It's amazing how many people still don't know the connection between puppy mills, backyard breeders, and online sites that sell puppies to pet stores. We can't seem to say it enough.
Borghese went to pet stores all over New York to investigate where they got their puppies. He speaks about the cruelty of puppy mills and the deception and greed of pet stores, who have no regard for the health and living conditions of puppy mill breeder dogs, which is where all pet store puppies come from. It's all about the almighty dollar to them.
I know personally that pet stores will not give you a straight answer, as Borghese also explains. You can tell it's a scripted response to your question. They paint a lovely picture of how the puppies' parents are living the good life, while in actuality they are living a lonely, neglected life in a cage, without clean food and water, covered in feces in wire cages, never allowed out, and inbred over and over.

Many online pet stores have images on their sites of bright green grass, with happy dogs running freely and enjoying the sunshine. This could not be farther from the truth, and it's simply a way to deceive the consumer. These dogs have never even felt grass under their feet.  If they showed you what was really going on, you would be appalled.
And when these dogs serve no more purpose to the puppy miller, they are sometimes killed.
Often the puppies from mills develop serious health problems that end up costing their owners thousands of dollars. This is a result of the terrible conditions their parents lived in, and the fact that they are inbred.
Does that sound like a good life to you? I have been told by pet store owners, "Oh no, we don't buy from puppy mills." They won't share the truth, so the lies never end.
When Borghese asked, "Is there a kennel name, something I can look up?", their response was, "That I can't give you. Not until you buy the dog." That should be an unacceptable response for any consumer. That should make anyone receiving that answer turn and walk out immediately.
In fact, you should never step foot into a pet store that sells animals, even to purchase supplies for your pet. Always shop at a store that only sells supplies or works with shelters to adopt homeless animals.
Make no mistake. If you buy a pet from a pet store, online brokers, or backyard breeders, you are buying a puppy mill dog and you are contributing to a money-making industry that condones cruelty and the inhumane treatment of animals.
Instead, please go to Petfinder.com or your local animal shelter to find your next pet. There are millions of dogs and cats killed in shelters every year who would have lived longer and healthier lives if given the chance.
Please pass this information to your family and friends so they will be able to make the right decision when looking for their next four-legged family member. This message cannot be shared enough. In fact, we can't stop sharing it until every consumer knows the truth about that "doggy in the window." Hopefully that will be when we will finally be able to say "goodbye" to these large scale commercial breeding operations, called puppy mills.

What Newport Needs to know about Puppy Mill Front Stores "I Heart Puppies" and "Russo's Fashion Island"

Puppy Mill Front Stores of
I HEART PUPPIES AND RUSSO'S
What The NEWPORT CITIZENS Needs To
Know About Puppy Mills

Puppy mills have been around for decades. They continue to thrive because they prey upon unwitting consumers who are smitten by too-cute-for-words puppies in pet store windows and on legitimate-seeming websites. Puppy mills house dogs in shockingly poor conditions. After their fertility wanes, breeding animals often are killed, abandoned or sold cheaply to another mill to try to get "one more litter” out of the dog. The annual result of all this breeding is millions of puppies, many with behavior and, or health problems

For starters, all puppy mills have breeding bitches and stud males and the only role they ever have in life is to reproduce. The don’t play, they’ve never known the warmth of a home, the gentle touch of a human hand, do not receive veterinary care when they are injured or sick and many die of disease and exposure.

Puppy mills are famous for creating mutts that they pass off to the public as designer dogs such as the Cocker-Poo, Maltee-Poo, Yorkie-Poo, among others. None of these breeds are recognized by the American Kennel Club and are a way to make a quick buck by selling mutts that people normally would give away for free. Breeding pedigrees, however, is what accounts for the bulk of their success. Puppy mill pedigrees often have a multitude of inherited behavioral and medical issues, which these animal assembly lines care little about. Their only goal is to produce as many puppies as they can, in as little time as possible, and sell them as quickly as they appear.

Bitches are neglected, have festering wounds, fleas, ticks, mange, lethal forms of dermatitis, round worms, tape worms, giardia from drinking foul water and many die whelping their young. Deceased bitches and studs, or those too old to reproduce are killed and disposed of in garbage dumps, freed to fend for themselves on the streets or sold cheaply to other mills in an effort to get one last litter out of them.

Breeding bitches are malnourished or forced to consume low-grade dog foods or their own feces and that of other animals to survive. As a result, their milk quality is poor, denying pups proper nutrition. Poor nutrition during nursing and after weaning affects brain and muscle-skeletal development, is suspect in the development of neurological disorders and more.

Puppies, adolescents and adults are housed together in wire crates often stacked one on top of the other. Most crates don’t have solid liners and feces and urine rains down upon those stacked below. Wires cut into paws causing sores and infections. In efforts to keep clean most dogs eat their own excrement. These learned poor elimination habits are suspect in the development of coprophagia — eating of stool, which is classified by some veterinary behaviorists as a form of obsessive compulsive disorder.

Two popular areas of the United States are home to puppy mills — southern states and the mid-west. Those located in the south house live merchandise outdoors where animals are exposed to rain, thunderstorms, wind, hurricanes and extremes in temperature. In the mid-west the same conditions exist, but dogs are commonly housed facilities located in warehouses or small buildings.

Pregnant females often are quite fearful and under tremendous stress during gestation.  As a result many of their pups develop into stressed, fearful or aggressive adults when they mature(1).

Early weaned pups and those removed from their mother and safety of their litters suffer psychologically as adults so they can have a longer shelf life in puppy stores. Since they are shipped as cheaply as possible, transport can take several weeks. This means most pups are removed from their litters as early as 4.5 weeks of age so they can arrive in pet stores by 8-10 weeks of age — denying them a crucial socialization period. This may explain why so many pet store dogs develop dog-on-dog aggression or fear-related issues.

During shipment at this crucial period in their lives they endure weeks of rough handling by scary strangers, may miss out on meals and access to clean water, subjected to temperature extremes and frightening sounds without the comfort of mom or litter mates to help them cope. During this socialization period puppies learn how their world operates and what they should expect from those living in it including other dogs, and humans. If their world is harsh and unfriendly it directly and adversely affects this learning period.

What puppy mills and pet stroes count on is most pups don’t display behavioral issues during puppyhood despite aversive early life experiences and remain cuddly, friendly creatures for up to 12-14 weeks of age. By this time they’ve already been sold and return policies have expired.

While puppies may begin exhibiting problem behaviors at 14+ weeks of age, the average age owners report behavioral issues to their vet or begin the search for professional help is around 3.5 years of age (adulthood). Issues may include, growling, snarling, resource guarding, aggression toward strangers, fear of new people, places and experiences (neophobia), eating its own or another dog’s feces (coprophagia), house soiling, aggression toward conspecifics (dog on dog aggression), fearful behavior toward owner (often misdiagnosed by vets as dominance aggression), sound sensitivity, separation anxiety, isolation anxiety, timidity, handling issues, excessive licking, spinning, obsessive disorders, neurological issues and more.

Medical disorders may include, but are not limited to, “weak” stomach with bouts of diarrhea, allergies, early onset cataracts, deafness, hypertropic osteodystrophy (sudden lameness, or growing pains) bladder issues, skeletal and neurological abnormalities, congenital defects, hip dysplasia, epilepsy and more.

While behavioral issues may be related to early life experiences in mills or even inherited from a litter from a reputable breeder, the difference between the two is a good breeder will take the dog back at any age, care for it the rest of its life, and offer you a complete refund. Most pet store return policies expire after 30 days, at which time the reported problems are yours forever.

Anyone involved in the sale of domesticated animals are required by federal law(2) to retain a copy of a health guarantee. When buyers purchase their pup they receive a copy of this guarantee. So if your pet store is attempting to dazzle you with a health guarantee as proof they somehow stand out from the rest in their line of business, don’t fall for it.

Under the federal Animal Welfare Act (AWA), the U.S. Department of Agriculture regulates commercial breeders, kennels, and brokers who sell dogs through wholesale channels and sets standards for the use of animals in biomedical and product research, circuses, zoos, and other public animal displays. Amendments to the AWA crop up in many sessions of Congress. In 2002, a proposal to allow federal oversight of breeding and socialization practices in regulated kennels was tacked onto the agriculture bill in the Senate but not the House of Representatives and was dropped from the final version of the bill.

Currently, the AWA applies only to commercial kennels that sell puppies to pet stores, but a lawsuit by the Doris Day Animal League (DDAL) could result in the addition of all breeders who have more than three intact female dogs to the law. DDAL won a court decision in its favor, but the US Department of Agriculture has filed an appeal. The AWA standards are written for commercial kennel buildings, but if the decision is not overturned, these standards will be applied to homes where puppies are raised as show dogs, working dogs, and performance dogs and for sale directly to the public as pets.
Unfortunately, regulations in the AWA are quite vague. For example, the AWA states that the animal needs to be evaluated by a veterinarian certifying that he inspected the animal on a specified date, and when so inspected, the animal “appeared” free of any public health disease or physical abnormality, etc.

The law does not specifically require the vet to run certain tests and relies on the appearance of the animal. This means anyone with a veterinary license can walk through a puppy mill to look at dogs and say they all “appeared” free of any public health disease of physical abnormality. On that end, a health guarantee isn’t always a guarantee that the animal is not diseased or doesn’t have the propensity to develop chronic behavioral/medical  issues.

When searching for a particular breed prospective dog owners are better off purchasing their pup from a reputable breeder who cares about the welfare of their puppies as well as their reputation in their line of business — one who stands behind their pups and cares about their future throughout their entire lives.
