CONTINUED~ According to the study, this can mean that after they are rescued, the dogs will need rehabilitation - and love - to overcome fears, phobias, heightened sensitivity to touch, house soiling and obsessive and repetitive behavior such as spinning in circles.   The study's lead author, Frank McMillan, DVM, Director of Well Being Studies for Best Friends Animal Society, elaborated "we can now scientifically confirm how truly destructive these places are for the dogs". Dr. McMillan worked on the study with researchers from the University of Pennsylvania School of Veterinary Medicine, James Serpell and Deborah Duffy.  The study was based on a definition of puppy mill that defined them as "commercial breeding operations..., ... large scale facilities where dogs are confined in small enclosures for their entire lives with little to no exercise or positive human contact-for the sole purpose of mass-producing puppies to sell in retail pet stores and via the Internet."

I Heart Puppies CRUMBLES –Exposed Fraud and Lies of Inhumane Puppy Mill Sales

Refusing requests to practice ethical humane business, I Heart Puppies closes shop , making unconscionable move to expand investments of cruetly and torture in unregulated Internet puppy mill sales.

Opportunity Lost-
Some may expect a humane advocate protester of IHP Puppy Mill Sales would be jumping for joy.   Our Protest  was not a battle of imposing will, but a battle to aide in diminishing a national crisis of  horrific canine cruelty, and aide needed humane opportunities for the city .  I Heart Puppies’ Brooke and Suanne Bradford ‘s Deep commitment to inhumane industry, denied our canine compassionate community a venue to create value, revenue , and  opportunity for humane pet sales, contributing to our citizen and canine welfare needs, while making exceptional and respectable honest profits.
What was the cost to the city for promoting and investing in unethical inhumane fraudulent sales of animal cruelty?
An endless string of unfortunate occurrences involving I Heart Puppies fraudulent misrepresentation was promoted and enabled by institutions citizens rely upon for integral preservation of ethical business and municipal duties.  
CDM Chamber marketed Fraud model.  Animal control negligence to enforce state law- engaging in private business animal trade for profit of our own homeless ,depriving them of legal advocacy.  Private business Illegal solicitation of charitable funds abusing tax payer services...and so on.
May the city of Newport Beach gain new insight to the hazards of promoting business at all costs, when business runs solely off a Fraud Model void of supply and demand.   The added sting, an industry of federal canine torture which congress and the entire nation are working furiously to regulate and overhaul,.  Newport  can no longer afford investing in it's growth, directly victimizes its own  citizens.
Had the city taken action and passed an ordinance banning Puppy Mill Sales in Newport, instead of offering resources, we would be celebrating 8 months of growth in revenues, creation of new jobs, displaying leadership in innovative, humane  high end business models, while providing housing opportunities for our homeless, diminishing federal cruelty….., instead of investing in it's growth.
On behalf of humane protesters I would like to thank the community of Corona Del Mar for your continuous support.   The support of the community kept us strong, fighting animal abuse injustice, for the greater good of our beautiful city.
A special Thank You to Honorable Mayor Nancy Gardner , in addressing the rights of her humane ethical citizens,  maintaining an ethical level playing field, and her  investment of valuable time spent gaining further insight on the facts of our  National Disgrace, the Puppy Mill Trade, still very much alive and prospering in Newport Beach.

Dog-Lovers Howl Over Alleged Puppy Mills

CHICAGO (CN) - Six puppy owners claim in a class action that the Happiness Is Pets chain store misrepresents that its puppies come from small-scale breeders, though they actually come from "some of the most despicable and horrendous puppy mills in the Midwest."
     Lead plaintiff Jane Clifford seeks punitive damages from 18 Happiness Is Pets branches in the Chicagoland area, and their owner Ronald Berning.
     "Plaintiffs purchased sick puppies sold by Happiness which falsely represented that its puppies were healthy and came from private and reputable breeders. In fact, the puppies at Happiness are often sick and come from some of the most despicable and horrendous puppy mills in the Midwest," the complaint states.
     It adds: "On information and belief, many puppies, no more than 8 weeks old, arrive at Happiness in crowded vans, packed in crates covered with feces and urine, shaking and visibly stressed, many sick. Happiness employees are directed to bathe and groom the puppies and administer antibiotics and deworming treatments daily, in an effort to mask the unhealthy condition of the puppies to unsuspecting consumers and of which dangerously jeopardizes the puppy's immune system."
     The plaintiffs' attorney Edward Clinton Jr. said in an interview with Courthouse News: "We received so many calls from so many people who had problems with Happiness pets that we thought it incumbent on us to file a lawsuit."
     The plaintiffs claim that "the breeders used by Happiness fit perfectly within the definition of 'puppy mill' as defined by Happiness. Many of Happiness' breeders are cited by the United States Department of Agriculture (USDA) for violations including but not limited to failure to provide veterinary care, lack of exercise, and improper housing enclosures. For example, the USDA reported that 'Breeder A,' a main breeder used by Happiness, failed to provide veterinary care to a blind dog with crusty eye discharge and to another dog with no teeth."
     The class claims that "the USDA reported an inventory count of another breeder used by Happiness, 'Breeder B,' of 890 dogs and 315 puppies. ...
     "'Breeder B' is not a private, small-scale breeder as Happiness falsely represents, and it is a mass producing dog facility.
     "An investigation by the Companion Animal Protection Society (CAPS), a nonprofit organization dedicated to protecting companion animals, further revealed a burn pile of puppies at 'Breeder B,'" according to the complaint.
     The plaintiffs say: "These deceptions are perpetrated so as to prevent plaintiffs from realizing the obvious - that purchasing a puppy from Happiness is a terrible idea and is financially and emotionally burdensome."
     Plaintiff Bryan Phillips says he bought his puppy, Dakota, from Happiness in December 2011 for about $809.
     "Shortly after Phillips' purchase, Dakota tested positive for distemper," the complaint states. "Dakota showed signs of illness immediately. He took Dakota to Happiness' recommended vet who dismissed her symptoms as a common cold and gave her a drug. Dakota's symptoms quickly worsened and Phillips took Dakota to his family vet, who noticed the signs of distemper instantly. A further X-ray showed Dakota had pneumonia as well. Dakota suffered from tremors, seizures, vomiting, severe diarrhea, coughing, eye and nose discharge, sneezing, respiratory problems, conjunctivitis and corneal ulcers."
     Plaintiffs Lissett Dzieglo and Mark Jillich say they bought their puppy, Gunner, from Happiness in January this year, for $976.
     "Gunner showed signs of illness immediately, including a severe cough, difficulty breathing and congestion," the complaint states. "Gunner was taken to the vet approximately five times in a matter of weeks. The coughing quickly worsened and elevated to bronchitis, eye and nose discharge, increased breath, clumsiness, lack of energy, and yelping in pain."
     The other plaintiffs say their puppies suffered similar health problems.
     "Our first goal is to get a class certified," Clinton said.
     The plaintiffs seek punitive damages for fraud, negligent misrepresentation, and breach of implied warranty, and want Happiness enjoined from continuing its allegedly deceptive practices. They also seek refunds of the price of the puppies, including all items associated with the purchases, and veterinary expenses.

THIS is what the public NEEDS TO KNOW..... everything is not fine, we are a nation who's government sanctioned agriculture business, condones torture for profit of man's best friend.

This is the manufacturing of USDA Pet Store Puppies... all Pet Stores in every city across the U.S., must buy USDA puppies by LAW.  Factory Breeders are not loving reputable breeders, they are in it solely for maximum profit, and veterinary care is never given as it cuts into the profit margin on sale of puppies to a store or a broker...

THIS IS ALL PET STORE PUPPIES and the suffering of a lifetime of their parents until they are killed inhumanely because they are no longer able to produce at around the age of five, or their breed becomes unpopular....often they simply starve them to death.

Residents Want Ban on 'I Heart Puppies' in Corona del Mar

Residents took to the podium at Tuesday's City Council meeting to ask for a ban on pet stores.

A group of animal activists and residents gathered at City Hall on Tuesday to urge the Newport Beach City Council to ban the retail sale of dogs and pets.
The requests follow months of controversy sparked by the "I Heart Puppies" Store in Corona del Mar. In July, the store came into the public spotlight when the Companion Animal Protection Society, a nonprofit group, launched an investigation into the store after complaints from residents and assertions that the store gets its puppies from Midwest puppy mills.
Since then, I Heart Puppies has been the subject of court hearings and several boycott/adoption rallies by the Animal Protection & Rescue League and other animal organizations.
Store owner Brooke Bradford has stated she does not support puppy mills or those with a history of problems with USDA requirements. She told the City Council she is looking forward to working with them, should they require any documents for an investigation.
"We have been to our breeders, we know them personally, we pick the dogs out and they are driven or flown back to our store," Bradford said. "They arrive at our store alive and well."
Dave Simon, an attorney for CAPS, was one of a handful of people who encouraged the council to pass an ordinance similar to the one the Irvine City Council recently approved, which bans the sale of dogs and pets in retail stores.
"We'd love to see Newport Beach take a similar and historic and responsible stand," Simon said.
Resident Alicia Culberstone echoed Simon's request.
"There is a growing wave of people choosing to adopt rather than shop," she said. "People would rather support humane conscientious businesses rather than those that greedily profit from cruelty."

CAPS began investigating Kathy Bauck, the owner and operator of "Pick of the Litter" in Minnesota, in 1997. Bauck, one of the largest USDA licensed dog brokers and breeders in the country, sold thousands of dogs to pet shops and Internet buyers all over the country.

Due to the efforts of the Companion Animal Protection Society, Bauck will no longer be able to sell to pet shops and other dog breeders and brokers. On August 13, 2009, the USDA/APHIS filed a Motion for Summary Judgment requesting the termination of Bauck's license. It is rare for the agency to request the termination of a license, especially through the expedited means of a summary judgment. CAPS believes the use of a summary judgment was due to the pressure APHIS felt from our petition for rulemaking mandating that USDA automatically terminate a license upon an animal cruelty conviction. On September 29, the administrative law judge issued a decision and order in the Bauck case, granting APHIS' motion for summary judgment. On October 29, Bauck appealed that decision to the judicial officer. APHIS filed a response to her appeal on November 18. The Judicial Officer's Order and Decision dated December 2 terminated Bauck's license. This termination was stayed pending Bauck's federal court appeal, which was denied. Bauck's license was officially terminated in August 2010. It is unfortunate that Bauck was allowed to keep her license during this yearlong legal process.


The USDA had licensed Bauck since 1983, and despite CAPS investigations since 1997, the USDA did not take action. The July 2008 USDA inspection report for Bauck found no violations of the Animal Welfare Act (AWA). They did not inspect her again until March 4, 2009, just three weeks before her conviction. The inspector cited her for veterinary and cleaning violations.


CAPS has been investigating the USDA's failure to enforce the AWA since 1995 and has been lobbying members of Congress for oversight hearings regarding USDA's lax enforcement of the AWA. CAPS went to Capitol Hill in June 2009 to meet with USDA officials and congressional aides, using the Bauck case as evidence of the USDA's dereliction of duty. CAPS' pro bono lobbyists submitted a petition for rulemaking requesting that AWA regulations be amended to require the automatic revocation of a USDA license upon the conviction in a court of law of a licensee, such as Bauck, for animal cruelty.


Based on evidence from a CAPS undercover employment opportunity of six weeks, a jury convicted Bauck on March 24, 2009 of four misdemeanor counts of animal cruelty and torture. On May 1, 2009, in what CAPS and animal advocates consider a great miscarriage of justice, the judge sentenced Bauck on just one of the counts, which he wrongly believed encompassed the other charges. She received a 90-day sentence, reduced to 20 days (weekday work release at the sheriff's discretion), a $500 fine (reduced from $1,000), 80 hours of community service and one year of probation.


While under a cease and desist order from the State Veterinary Board for the practice of veterinary medicine, including doing C-Sections on her dogs, Bauck continued to practice vet medicine, which was documented by her employees. However, the state allowed her to plea bargain for just one charge for the practice of veterinary medicine and dropped the cruelty charge for killing a puppy by bashing it against a pole. While on parole and serving work release, she continued to commit cruelty that was documented by a CAPS undercover investigator. CAPS submitted the investigator's hidden camera footage, photographs and reports to local authorities. This documentary evidence was the basis of the criminal case against Bauck.
At the time of the investigator's employment, Bauck's facility held 900 adult dogs and approximately 400 puppies. The undercover video shot by the CAPS investigator shows dogs that are sick, wounded, and emaciated. Dogs at her facility commonly became wounded through fights, even some of the small breed dogs.


Bauck will still be able to sell dogs on the Internet. The Animal Welfare Act does not cover Internet breeders. However, if proposed legislation in Minnesota requiring state kennel licenses is passed, those convicted of animal cruelty and their business associates will be banned from obtaining a license. CAPS plans to investigate numerous Minnesota puppy mills to provide evidence in support of this legislation.
The Bauck case made national headlines with coverage by CBS stations in Chicago, Minneapolis and Los Angeles. CBS Chicago had the exclusive interview and footage. ABC in Boston aired a number of reports on the Bauck case. Bauck sold dogs to several pet shops and to Internet buyers across the state of Massachusetts. CAPS is about to make public a documentary about the Bauck investigation and criminal case.

There are many victims of Puppy Mills. The mill dogs, their sickly offspring shipped from the midwest by truck or airplane that spend a lifetime suffering genetic ailments, the shelter puppy who is murdered because he has no home. Newport Beach sells animal cruelty to line the pockets of a few greedy INHUMANE business owners. Newport Beach has many profitable HUMANE Pet Stores that benefit highly financially. Newport Beach Pet Stores must be mandated to practice a Humane Business Model. Less our entire city commits itself to the sale and profits of animal torture and death for unethical businesses committing illegal consumer fraud, and victimizing our citizens and children.

A northwestern Minnesota dog breeder who continued to sell dogs after her license was terminated for two years had her license permanently revoked in September, according to a consent order made public last month by the U.S. Department of Agriculture.

The department initially terminated the license of Kathy Jo Bauck, a New York Mills resident, in 2009 based of a criminal conviction for practicing veterinary medicine without a license and a conviction of overworking or mistreating animals.

Bauck appealed, arguing that the jury verdict was based on fraud and misrepresentation by a member of the advocacy group Companion Animal Protection Society (CAPS), who, according to the society, secretly recorded conditions at Bauck's business.

The termination, similar to a suspension, was made final in August 2010, but the USDA found that Bauck continued to conduct business.

The revocation also bans her husband, Allan R. Bauck, and their most recent business, Pine Lake Enterprises Inc., from acting as an animal dealer. The Baucks were fined $100,000, but $95,000 was stayed as long as they comply with the order.
The Baucks are allowed to own no more than six dogs at a time, with no more than three being unspayed females.

The Office of Inspector General for USDA has released a scathing 69 page report for an audit and investigation conducted between 2006 and 2008.  This audit/investigation was prompted by a May 2006 meeting between OIG officials, CAPS and Crowell & Moring attorneys, who provide pro bono counsel and lobbying to CAPS.
