Hello Honorable Mayor Gardner and Manager Kiff,
I read this article in the Daily Pilot:
CITY LEADERS DISCUSS PROGRAM OF RELEASING NONVIOLENT CRIMINALS
Newport Beach mayor says the Police Department has taken some proactive steps to keep residents safe.
I took special notice you were making "changes" and "realigning" in our police department of city employees.
"Well, obviously it's a matter of concern," Mayor Nancy Gardner said, encouraging residents to lock their vehicles and homes to prevent property crimes.
Recent changes in the Police Department are a move in the right direction toward preparing for possible ramifications of realignment, she said.
"I'm very pleased though that our Police Department has taken such proactive steps to be anticipating and restructured some of the duties," Gardner said. "I think that's something our residents can take comfort in."
I would like to take this opportunity to recommend , such as other residents already have, that our entire animal control department be replaced by officers qualified competent to enforce mandatory laws of the state. I would recommend ones that aren't involving the city in illegal solicitation of funds defrauding the residents and do not abuse power of control over our cities animals for "personal" or "city of Newport Beach" gain.
The same animals which every single tax payer in the city pays them to uphold animal laws for the entire State of California in private businesses and the ones under care of tax payer contract at our O.C. Humane Society where they can at least be held under protection of laws enforced through Animal control officers of Huntington Beach in their jurisdiction. Council Keith Bohr of Huntington assured me state laws are enforced in his city and he is a politician that exhibits ethical humane character that is reliable.
You may also want to encourage residents not only to lock their cars, but keep their children out of Russo's Convicted Cruelty Criminal Pet Store. Dan Digiacomo was convicted of Animal Cruelty Statute Penal Code 597.1 (a). He was prosecuted in Orange County Superior Court by three District Attorneys and PLED GUILTY to malicious and intentional mischief which is criminal cruelty to animals. He served three years probation ending in 2008 and was represented by Attorney Kelly Johnson who is active registered agent of his private business,Russo's Pet Experience in Newport Beach located at 1013 Newport Center Dr., Newport Beach , CA, 92660.
Dan Digiacomo being a cruelty criminal posses a safety threat to our community, families, and animals. Specifically the children he lures into the store by stroking and petting a puppy in the front doors of his business. I don't need to explain how this behavior is extremely predatory. Please take a moment to fully understand this credible risk.
-One of the known warning signs of certain psychopathologies, including anti-social personality disorder, also known as psychopathic personality disorder, is a history of torturing pets and small animals, a behavior known as zoosadism. According to the New York Times, "The FBI has found that a history of cruelty to animals is one of the traits that regularly appears in its computer records of serial rapists and murderers, and the standard diagnostic and treatment manual for psychiatric and emotional disorders lists cruelty to animals a diagnostic criterion for conduct disorders. "A survey of psychiatric patients who had repeatedly tortured dogs and cats found all of them had high levels of aggression toward people as well, including one patient who had murdered a young boy."
Newport Beach Animal Control has failed to enforce law in compliance with 122354. Care and maintenance of animals; presence of operator or employee; care requirements on several occasions including recording violations of state law for legal documents I possess and requested processing which continues to go denied and is not subject to ANY "reasonable belief" but is required as sole regulator of law for the state of California.
Please contact me regarding these issues so that citizens, valued patrons, and OCSPCA's valid, legitimate, and unquestionable documented evidence and testimony may be recorded. The behavior of Newport Beach Animal Control has been egregious and the tax payers and constituents of Newport Beach are demanding accountability of officers in alignment with Newport Beach Police Internal Procedures.
Also, I have requested several times for the tax deductible foundation number for 'Pick a Pet", a city foundation for which I have witnessed the opportunity provided to every citizen of the city to donate in efforts of easing the suffering of our homeless animals and provide them with Veterinary Care. Owning adopted shelter dogs and aiding daily efforts to Rescue them from local kill shelters, I am requesting I also be provided this opportunity of donation. Conduct to this point in refusal to supply me this, have been actions resembling police discrimination by the city. I believe my efforts of 2 years as Federal Defense Witness for the City of Newport Beach, my birth status as native, my residency, constituency and taxes paid to the city, afford me this equal opportunity and I am requesting this now.

subject: Failure to Care for Animals - Russo's Diseased White Persian Kitten
Spencer,
You told me in an email you would contact me on Tues when you arrived back in the office. It is now past 4:00p.m. on Thursday and I have failed to hear from you.
The law allows this visibly diseased kitten medical care with out delay Your officer Valorie Schromburg received this evidence 2 weeks ago that included photo evidence of diseased kitten along with complaint of cruelty and neglect that is required by law to be investigated. Valorie not only failed to provide necessary medical treatment under the law, she dismissed investigation and required report of such.
Upon your failure to promptly address concerns and provide this kitten required medical Veterinary treatment "with out delay" the OCSPCA conducted a welfare check on the kitten July 11, 2012. Their eyewitness was contrary to your officer Valorie Schromburg's Failure of required investigation and confirmed this kitten to be in diseased state and still on the floor for sale in the front window. Your officer failed to act promptly upon receiving their phone calls of concern about this kitten.
This is the second eye witness of the kitten exhibiting symptoms of disease for which "The City of Newport Beach" has failed to adhere to state law in responding to provide medical treatment with out delay of an animal exhibitingsymptoms of disease while unlawfully placed for sale in the front store of Russo's pet Store. You received a written testimony of eye witness condition of animal, evidence of photo confirming his complaint addressed to OCSPCA regarding your departments failure of adequate investigation under state law and failure to provide medical treatment with out delay. I forwarded this to you myself.
Your personal visit to the pet store detailing the kitten had food and water and was still for sale details this store is violating the law in failure to care for animals and criminal neglect. Your visit was the second time "The City of Newport Beach" failed to adhere to state law in providing this animal medical examination by a Veterinarian. It is the second failure to issue a report of non-investigation and I am once again requesting the NBPD procedure detailing that this incidence was addressed adhering to Newport Beach Police Protocol.
I am certain Manager Kiff and Mayor Gardner, both who are responsible humane employees of the City of Newport Beach, do not wish for the city itself to be subject to implications of criminal neglect and cruelty. I am certain they prefer the city not be subject to protest by citizens and patrons for aiding and abetting this Inhumane Industry Pet Store in cruelty to animals violating state laws and referred to as a "Kitten Killer."
I ask you, what kind of person, law enforcement department, pet store, or city is so unconscionable they violate state laws forcing a helpless a helpless baby kitten to suffer under reported and photographed state of disease. Although the label of "Kitten Killer" is offensive, so is allowing a helpless suffering animal to die with malicious and intentional Failure to Care for Animals
As I stated before, this is not "Persian Eyes." I owned this exact kitten and hands on cleaned "Persian Eyes" as well as treated for Upper Respiratory Infection during outbreaks of disease my kitten carried upon purchase from Russo's Pet Experience in 2002. I have told you this condition is fatal to this breed and must receive Veterinary Care as stated by Veterinarian Medicine itself. You have ignored experience far greater than Valorie's 40 hours of husbandry education which DOES NOT include education of "Persian Eye." I would verification of classes she has obtained to make such a conclusion. Where does her education of "Persian Eye' expertise come from and Yours for that matter. Is this simply what the pet store told you? Do you listen to Dan Digiacomo who is proven to defraud Governments, media, and consumers with a long recorded history of animal neglect. Your department ignored concerns of the Orange County Society in Prevention of Cruelty to Animals who was force to make their own welfare and eye witnessed the condition of disease AGAIN.
I will once again educate you with my extensive HANDS ON TRAINING WITH EXACT BREED OF WHITE PERSIANS FOR FIVE YEARS owning and caring for one. Persian eyes is an entirely different color, different consistency and does not discharge from the nose. It does not create swollen facial and eye tissue, does not create the obvious symptoms of lethargy and depression in this kitten. THESE ARE ALL VISIBLE SYMPTOMS OF DISEASE. There will not be a medical expert independent from your department or Russo's pet Store that will agree and I am stating this in confirmation from Medical Expert all ready given to me upon viewing photo.
Please provide me with additional information requested in previous emails you have failed to provide given evidence warranting such request.

LETTER FROM CONCERNED CITIZEN TO OCSPCA REGARDING N.B. ANIMAL CONTROL
Kitten at Russo's Pet Experience
I'm writing because of a recent experience I had with Orange County Animal Control. About a week ago, I visited Russo's Pet Experience in Newport Beach. Every time I've visited their facility in the past I've been less than impressed, but this time I was shocked by what I saw. In the front window was a tiny Persian kitten that looked half-dead. It appeared to be in a daze and didn't move the entire time I was in the store. It also had a rather large amount of build-up in its eyes. (I've attached a picture I took.) Having fostered kittens for OCARC in the past, I'm able to spot a sick cat when I see one. This cat in particular, had it been in my care, would have been rushed to the vet a long time ago.
I didn't bring it to the attention of the store; mainly because their staff is populated by a bunch of teenagers who would rather text than do their jobs. The mere fact that this had gone unnoticed (for a kitten in the FRONT window) says a lot about their staff. So instead I reached out to someone on Yelp, trying to find out what I should do. She advised I contact Animal Control.
So I did. And Animal Control headed out to Russo's and then sent me this message:
Animal Control went out and saw the kitten. We saw all the records of the kitten, including the vet records.. The kitten has the typical “Persian” cat eyes and it has been addressed. The kitten was eating when Animal Control walked up to the window.
There will be no report taken due to no evidence of a crime. Your call is documented in the PD CAD system.
If you have any questions, please don’t hesitate to contact me.
This just doesn't sit well with me. First off, every-single-person I've shown this picture to (including vet techs and members of the OCARC) says the kitten appears to be quite ill. Second, why is it not protocol to have the kitten inspected by an actual vet at the time of the inspection? It seems the vet records won't show anything other than the fact that the kitten WAS in good health at some point. This "investigation" seems shoddy at best.
So, as you can see, the case is closed, but I don't really feel right about the experience. The kitten is clearly sick, and yet it continues to sit in the front display. Do you know of any other steps I can take? Or should I really just consider this matter closed?
